What makes a divorce “uncontested”

A divorce is uncontested when both spouses agree on every issue, including:

  • How to divide property and debts
  • Whether either spouse will receive alimony
  • If you have children: the parenting plan, time-sharing schedule, and child support

At least one spouse must have lived in Florida for six months before filing.

Two ways to file

  • Simplified dissolution of marriage. Available only if you have no minor or dependent children, the wife is not pregnant, neither spouse is seeking alimony, you agree on dividing property and debts, and both spouses are willing to sign the papers and attend the final hearing.
  • Uncontested dissolution with a settlement agreement. Used when you have children or do not meet the other requirements. We prepare a marital settlement agreement and, if needed, a parenting plan for the court to approve.

Why use a lawyer for an uncontested divorce

“Uncontested” does not mean “simple.” A missing term in your agreement, such as how a retirement account will be divided, who keeps the house, or how holidays are shared, can lead to costly problems later. We make sure your agreement is clear, complete, and enforceable, and we handle the filings so the case moves smoothly.

The process

  1. Consultation. We confirm you qualify and review what you have agreed on.
  2. Agreement. We draft the marital settlement agreement and parenting plan.
  3. Financial disclosure. Required documents are exchanged and filed.
  4. Filing. We file the petition and agreement with the court.
  5. Final hearing. The judge reviews the agreement and enters the final judgment.

If the agreement breaks down along the way, we can help you through a contested divorce.

Frequently asked questions

How long does an uncontested divorce take in Florida?

Often a few weeks to a couple of months, depending on how quickly the paperwork is completed and the court’s schedule. Florida requires at least 20 days between filing and the final judgment.

Can one lawyer represent both of us?

No. A lawyer can represent only one spouse. The other spouse may hire their own lawyer or represent themselves.

Do we have to go to court?

Usually there is a short final hearing, which in Miami-Dade is often held by video.

What if we agree on most things but not everything?

Mediation can often resolve the remaining issues so the case can still settle without a trial.
